ELIGIBILITY.  Deseret Industries Piano Giveaway (the “Giveaway”) is open to individuals 18 years of age and older living in the United States (except Alaska or Hawaii) and the District of Columbia. Employees of Sponsor, its respective parent, subsidiaries, related and affiliated entities, suppliers, as well as the immediate family (spouse, parents, siblings and children) and household members of all parties are not eligible.  The Giveaway is subject to all applicable federal, state, and local laws and regulations. Participation in the Giveaway constitutes entrant’s (“Entrant”) full and unconditional agreement to these official rules (the “Official Rules”) and Sponsor’s decisions, which are final and binding in all matters related to the Giveaway. Winning a prize is contingent upon fulfilling all requirements set forth herein.

SPONSOR.  The Deseret Industries, 50 North West Temple, Salt Lake City Utah, 84101 (“Sponsor”).

GIVEAWAY SUBMISSION PERIOD. Submissions will be accepted from June 5, 2017, at 10:00 a.m. MDT through July 10, 2017, at 10:00 a.m. MDT (the “Giveaway Period"). Sponsor’s time clock is the official clock for the Giveaway. Entries received prior to or after the Giveaway Period are considered invalid.  Three finalists will be selected and posted to Deseret Industries Facebook page on July 18, 2017.  The Winner will be selected from among the three finalists, as described in these Official Rules.

HOW TO ENTER. No purchase necessary to enter or win. Incomplete entries are void.  To enter, during the Giveaway Period (a) post a picture of your DIY project using your personal Facebook, Twitter, or Instagram account and use the official hashtags #DeseretIndustries and #DIwhy; (b) “Like” the Deseret Industries Facebook Page, (c) email a screenshot or photo of your post to piano@deseretindustries.org; and (d) complete and return the online form that will be emailed to you.  The online form will ask you to provide certain personal contact information and agree to the terms of the Giveaway.  The online form will ask for your name, email address, mailing address, and telephone number.  The personal information collected will be used solely for purposes of the Giveaway, and will not be sold to or shared with any third party. 

There is no limit on the number of entries. Eligibility will be verified based on the natural person assigned to the email account used to submit the entry.

SUBMISSION REQUIREMENTS. Individuals may post multiple times on multiple social platforms. Entries must not contain any obscene, profane, lewd, defamatory, or inappropriate matter as determined by Sponsor in its sole discretion. Any entry deemed unsuitable by Sponsor, in its sole discretion, will be disqualified.  Any Entrant whose submission includes the name, image, or likeness of any third party or that contains elements not owned by the Entrant (including, but not limited to, music, trademarks, images, or logos) must be able to provide Sponsor with valid releases, in a form acceptable to Sponsor, for all such materials, so that Sponsor has an unlimited right to use the submission in any and all manners that Sponsor, in its sole discretion, deems appropriate. Entrants whose submission includes the name, image, or likeness of one or more minors must be able to provide Sponsor, upon request, releases signed by the parent or legal guardian of such minors, so that Sponsor has an unlimited right to use the submission in any and all manners that Sponsor, in its sole discretion, deems appropriate.

RELEASE.  By participating in or entering the Giveaway, Entrant agrees to defend, indemnify, release, and hold harmless Sponsor including its respective directors, trustees, officers, committees, subsidiaries, affiliates, employees, agents, assigns, third party information providers, and representatives (collectively, “Sponsor Indemnitees”) from and against any and all claims (including, but not limited to, claims of patent, trademark, and copyright infringement), demands, actions, damages, losses, costs, liabilities, expenses (including reasonable attorneys' fees and other legal expenses), awards, fines, and judgments asserted against or recovered from Sponsor arising out of or related to: Entrant’s participation in the Giveaway or Entrant’s submission; and any act, conduct, omission, negligence, misconduct, or unlawful act (or act contrary to any governmental order or regulation) by Entrant, including, but not limited to, any act or omission resulting in personal injury, damage or loss of property, or breach or violation of these Official Rules or the rights of another person. Sponsor shall not be liable in any way for injuries to persons or damages to property incurred or suffered by Entrant or any of Entrant’s subcontractors, agents, heirs, successors or assigns, or any person related to Entrant in any way.

JUDGING.  A panel of five DIY enthusiasts will select three finalist entries from among all of the qualified submissions. The panel of DIY enthusiasts will use the following criteria to evaluate the entries:  originality, creativity, potential for success in raising awareness of Deseret Industries, and relevance to the Giveaway theme of giving new life to items people no longer use by donating such items to Deseret Industries. On July 18, 2017, the three finalist entries will be posted on the Deseret Industries Facebook page. The winner will be determined by July 21, 2017 at 11:00 a.m. MDT based upon the number of audience “Likes” the entry receives by July 20, 2017 at 10:00 a.m. MDT.

GRAND PRIZE WINNER, WINNER SELECTION. One winner (the “Winner”) will be selected from among the three finalists based on the number of “Likes” their DIY project submission receives during the period of time between the posting of the three finalists’ submissions and the closing of voting. The cutoff for voting by “Liking” a submission will be July 20, 2017 at 10:00 a.m. MDT. The Winner will be notified via email. The Grand Prize is a $100 gift card to Home Depot and the refinished piano featured in the video “A Piano’s Life.” The Grand Prize will be delivered to the Winner within (30) days following notification of the Winner. The Winner must provide Sponsor with the appropriate address and delivery information, which must be within the United States (except Alaska or Hawaii) or the District of Columbia.

PRIZES, APPROXIMATE RETAIL VALUE (“ARV”) & ODDS : The Winner will receive the Grand Prize, which consists of a $100 gift card to Home Depot and the refinished piano featured in the video entitled “A Piano’s Life,” which will be delivered to the Winner at Sponsor’s expense. The value of the Grand Prize is estimated to be $800.00.  Odds of winning depend on the number of entries received during the Giveaway Period.  Non substitution, cash redemption or transfer of Grand Prize is permitted except at Sponsor’s sole and absolute discretion. If the Grand Prize, or any portion thereof, cannot be awarded for any reason, Sponsor reserves the right, at its sole and absolute discretion, to substitute a grand prize of equal or greater value. All federal, state and local taxes, and all other costs associated with acceptance or use of the Grand Prize are the sole responsibility of the Winner. Arrangements for delivery of the Grand Prize will be made after the Winner is validated. At the Sponsor’s discretion, unclaimed prizes may not be awarded.

GENERAL RULES: Winner will be notified by email response to their original email submission. Winner may be required to sign and return an Affidavit of Eligibility and Release of Liability and a Publicity Release and an IRS W-9 form within ten (10) days of attempted notification or prize may be forfeited. The return of any prize/prize notification as undeliverable or failure to respond to notices or return any documents in a timely manner, as determined by the Sponsor, may result in disqualification and an alternate winner may be chosen. By participating, Entrants agree to release, discharge and hold harmless Sponsor from and against any and all liability or damages associated with this Giveaway or acceptance, use or misuse of the Grand Prize received in this Giveaway. Sponsor is not responsible for any typographical or other error in the printing of the offer or administration of the Giveaway. By participating in this Giveaway, Entrants agree to be bound by the Official Rules and decisions of the independent Sponsor, which shall be final in all matters relating to the Giveaway. Sponsor is not responsible for lost, late, misdirected, stolen, illegible, inaccurate, damaged, incomplete, non-delivered or postage-due mail; or for printing, distribution or production errors or for technical, hardware, software, or telephone malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the user or by any of the equipment or programming associated with or utilized in this Giveaway, or by any human, or other error, which may occur in this Giveaway. If, in the Sponsor’s sole opinion, there is any suspected or actual evidence of tampering with any portion of the Giveaway or if technical difficulties compromise the integrity of the Giveaway, Sponsor reserves the right to void suspect entries and/or modify and/or suspend and/or terminate the Giveaway and/or conduct a random drawing to select a winner in a manner deemed appropriate by the Sponsor. In the event of a dispute regarding the identity of the person submitting an entry, entries will be declared made by the individual assigned to the email account used to submit the entry. Sponsor reserves the right to disqualify any individual who tampers with the Giveaway or acts in a disruptive manner. This Giveaway is offered only in the United States and is governed by the laws of the State of Utah. By entering, Entrants irrevocably consent to the sole and exclusive jurisdiction of the courts of the State of Utah located in Salt Lake County for any action, suit or proceeding arising out of or relating to this Giveaway.

By participating in or entering the Giveaway, Entrant grants Sponsor a worldwide, royalty-free, irrevocable, perpetual, non-exclusive license to print, publish, reproduce, perform, edit, distribute, display, transmit, broadcast, sell, license, sublicense, modify, create derivative works from, and otherwise use or allow others to use Entrant’s submission and any description of the submission in whole or in part, in any program, distribution channel, publication or promotional device of Sponsor and in any form, media, or technology now known or later developed, including using the submission for promotional and marketing purposes, all without attribution or compensation to Entrant and his/her successors or assigns. The grant of rights herein shall include, but is not limited to, the right to adapt, perform, reproduce, distribute, license, or otherwise use the submission, or any portion thereof, alone or in conjunction with other materials, in all types of electronic, digital, online, computer-based media and technologies and any other system or medium now existing or hereafter developed, as well as the storage, retrieval, transmission, display, output and reproduction of data through any such media and technologies. Entrant will sign any necessary documentation that may be required by Sponsor to make use of the non-exclusive rights Entrant is granting to use the submission.

Additionally, by participating in or entering the Giveaway, Entrant agrees to the worldwide publication and/or display of his/her name and likeness in connection with his/her submission, the decision for which will be made at the discretion of Sponsor, except where prohibited by law. Furthermore, acceptance of any award shall constitute and signify winner's agreement and consent that Sponsor and its designees may use the winner's name, likeness, biographical materials, image, photo, submission, and/or award information for advertising, promotional, publicity, and other purposes, worldwide, in any and all media now known or hereafter devised, including posting the submission online and on social media channels, for editorial purposes concerning the Giveaway and for editorial publicity, special events and advertising purposes in connection with promoting Sponsor, its products, its website, its social media channels, and/or this Giveaway or succeeding contests, without limitation and without further payment, notification, permission, or other consideration, except where prohibited by law.

WAIVER: By participating in this Giveaway, Entrant waives all rights to claim punitive, incidental and consequential damages, attorney’s fees or any damages other than actual out-of-pocket costs incurred to participate. Winner waives all rights and indemnifies Sponsor against any loss or liability claim, cause of action or liability, including without limitation those relating to any personal injury, death, loss, expense or damages of any kind, under any theory of law or inequity, arising from, acceptance or use of and/or resulting from the Grand Prize.

PUBLICITY. Unless prohibited by law, participation in the Giveaway constitutes each Entrant’s consent for Sponsor to use the Entrant’s name, age, photograph, image, likeness, statements and content of Giveaway submission for Giveaway or other promotional, advertisement or commercial purposes in any media now known or later developed, without payment or consideration to the Entrant or any other person.

PRIVACY. Sponsor will collect personal data from Entrants when they enter this Giveaway, and this information will be used for the purposes of administering the Giveaway, publicizing the Giveaway and other promotional purposes that may benefit Sponsor.

MISCELLANEOUS. Each entry is subject to verification by Sponsor. Participation in the Giveaway constitutes agreement and acceptance of these Official Rules. Entrants hereby waive any right to claim ambiguity in these Official Rules. Sponsor reserves the right to apply and interpret these Official Rules and conduct and administer the Giveaway. Any decision by Sponsor regarding the Giveaway, including eligibility of Entrants and determination of the winners, shall be final and binding.

RIGHT TO CANCEL OR MODIFY GIVEAWAY. If the Giveaway is not capable of running as planned for any reason or cause which Sponsor deems could corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Giveaway, including fraud, technical failure, or insufficient participation, Sponsor reserves the right to cancel, terminate, modify or suspend the Giveaway or these Official Rules, including changing the Giveaway Period, or selecting a winner from entries received prior to the action taken or in such other manner as Sponsor may deem appropriate.

DISCLOSURE OF WINNERS. We will post the winner on the Deseret Industries Facebook page located at https://www.facebook.com/deseretindustriesthrift by 11:00 a.m. MDT on July 21, 2017.
